Introduction

The Terms and Conditions (collectively “terms”) listed within this page will be binding to all users on all functions or platforms wholly owned by Megamind Tuition Singapore Pte Ltd (“Megamind Tuition Singapore”, and collectively “we”, “us”, “our”). This include, but not limited to, the Megamind Tuition Singapore’s website, Megamind Tuition Singapore’s mobile application, all circulated documents, agreements and any relevant information that deemed material. It is the responsibility of all users and visitors to any of these functions or platforms owned by Megamind Tuition Singapore to read and be familiar with the terms and conditions listed. Megamind Tuition Singapore trusts that by accessing and usage of our platforms and services, all users had carefully considered, and provided their consent and acceptance to all of the terms and conditions listed herein. Should you have any disagreement with the terms and conditions listed, you shall automatically cease access and usage to all our services and functions, with immediate effect.

Services of Megamind Tuition Singapore Pte Ltd

Megamind Tuition Singapore provides a one-stop solution for all your additional or supplementary academic needs. We strive to connect all tutors and tutees through the Megamind Tuition Singapore’s mobile application, meeting the unique demands for each of our users, both tutors and tutees alike.

All users and visitors with access and/or usage to any/all the functions and services provided by Megamind Tuition Singapore shall be at least eighteen years of age. Any users or visitors below the age of eighteen upon the time of usage and procurement of our services shall be deemed to have their parental/guardian consent and acceptance to all the terms and conditions listed herein.

Megamind Tuition Singapore reserve the rights to verify all accounts created by its users. In the event of any non-conformity, fraudulent or suspicious activity picked up by our in-application algorithm, Megamind Tuition Singapore shall further investigate and if need be, cancel or discontinue all/certain services to the said user.

It is the sole responsibility of all users to uphold the agreed time, date, duration, venue and costs of each registered tuition class. Megamind Tuition Singapore shall not be liable for any missed/late/rescheduling of tuition classes, or any significant change of events that causes an alteration to the agreed conditions as set in each user account, regardless of any reasoning.

Account Registration

In order to start using the services provided by Megamind Tuition Singapore, all users are to register an account, prompted within the mobile application.

To register an account with Megamind Tuition Singapore, you shall provide accurate and current personal information in whole, such as, and not limited to, Full name as in NRIC, active email address, age, gender, academic qualifications, residential address and mobile number. For tutors’ registration account setup, you are to upload a valid, authentic and most-relevant proof of qualification/certification for our verification.

Each Megamind Tuition Singapore account holders shall be the sole-owner and the only authorized person to the usage of its account and contents. Each respective user are to be accountable for all activities and transactions that occurred within each individual account. Registered account user shall not share or disclose any personal or sensitive information, which includes personal log-in details, that might result in potentially unauthorized usage or suspicious/fraudulent activity that is non-conforming to the terms and conditions of Megamind Tuition Singapore.

Should there be a suspicion of a breach of security or any unauthorized access to your account, it is your sole responsibility to change your password immediately and notify Megamind Tuition Singapore at the earliest possible time. Megamind Tuition Singapore shall not be held liable for any loss and damages arising from a failure to comply to any of the terms stated herein.

All personal information submitted to Megamind Tuition Singapore will be treated with utmost confidentiality. For further information, please refer to our privacy policy page.

Rescheduling of classes

All users, both tutors and tutees alike, are encouraged to constantly monitor and be aware of their agreed tuition schedule set within the Megamind Tuition Singapore mobile application.

Should there be any rescheduling required, this shall be applied through the application at the earliest notice. The agreement to the rescheduling will be automatically coordinated through the in-application rescheduling function between tutors and tutees, and will be subjected to approval by both parties. Should any of the party disagree to the newly proposed time and/or date, the original class details shall prevail.

Change of tutor

In the event where a tutee disagrees with the teaching style of the tutor, a change of tutor can be arranged after completion of 4 lessons with the existing tutor. Megamind Tuition Singapore believes that it will take time for both tutor and tutee to adapt to a specific way of teaching. However if a tutee still decides to proceed with changing the tutor after 4 lessons, this could be arranged through the mobile application, or with the help of our administrator.

There will be strictly no refunds allowed on lessons that have commenced. Megamind Tuition Singapore believes that tutors shall be paid accordingly as agreed for the time and effort spent.

In a case of a criminal offence or a serious breach of terms by the tutor, a tutee can raise the issue immediately to the administrator of Megamind Tuition Singapore. An immediate change may be arranged on a case by case basis.

Payments collection and disbursement

Payments for all tuition classes are collected from tutees and disbursed to tutors on a monthly basis. All payments collection and disbursement will be done automatically within Megamind Tuition Singapore mobile application.

At the closure of each month, all month-to-date tuition activities and its fees for each session will be consolidated on a monthly invoice and made available on the mobile application. All fees and charges reflected on the Megamind Tuition Singapore mobile application is in the currency of Singapore Dollars (SGD).

Payment collection from tutees

Monthly tuition fees will be charged on the final day of each month based on the number of tuition classes and rates agreed in the job posting. The total amount payable for the month will be withheld under Megamind Tuition Singapore, and will be paid to each respective tutors on Megamind Tuition Singapore’s paydate. In the situation where Megamind Tuition Singapore is unable to deduct the necessary fees on the final day of the month, or when tutees prefer to perform direct payment to Megamind Tuition Singapore, tutees are allowed to make bank transfers directly to Megamind Tuition Singapore within 5 business days after the month closes. Any payments outstanding as at the 5^th business day after the close of the month, after 23:59pm, shall be deemed as a late payment.

The hourly tuition rates are solely set by the tutee in the job posting. Upon job acceptance by a tutor of choice, the tuition rates agreed will be final and binding. No further changes will be made to the rates thereon.

The tutee shall pay the full amount as stated in the monthly invoices in Singapore dollars (SGD). The monthly invoice calculates the total fee payable for period from 1^st of the month at 00:00am to the final calendar day of the month, 23:59pm.

Notwithstanding, tutee will be responsible for the payment of all prevailing local taxes and/or duties imposed by the local tax authorities, if any.

Tutees are encouraged to utilize credit/debit card as the preferred mode of payment for all monthly recurring fees. Additionally, direct bank transfers are accepted. Megamind Tuition Singapore do not accept cash payments.

In the event of a late payment, or any outstanding amount owed to Megamind Tuition Singapore after the final day of each month, Megamind Tuition Singapore will seek for settlement directly via phone calls, emails, mobile text messages or any other means deemed helpful. Should the payments continue to lapse, the account may be further referred to our legal team for any necessary legal actions. Through this process, tutees shall be held liable for all relating costs incurred in upholding the settlement, including but not limited to, administrative fees, legal fees, debt recovery and solicitor fees. A late payment charge of SGD $25.00 will also be strictly imposed by Megamind Tuition Singapore.

All classes that commenced shall be charged at the full agreed rate. There will be no refunds or negotiation on the tuition fees. Tutees will be charged strictly based on the agreed duration and rates in the accepted job posting. It is the responsibility of both the tutors and tutees to enforce the full duration of tuition class as listed in the mobile application.

Payment disbursement to tutors

Monthly tuition fees will be disbursed to the tutors on the 10th day of each month based on the number of tuition classes and rates agreed in the job posting. Should the 10th day of the month falls on a weekend or a public holiday, the payments will be disbursed on the immediate next working day that follows.

The total amount payable for the month will be in-line with the invoice issued. All payments received will be in Singapore Dollars (SGD).

It is the tutor’s sole responsibility to provide accurate and active bank beneficiary details for our processing. Payments will be strictly disbursed to the beneficiary account as listed in your Megamind Tuition Singapore’s tutor account. Megamind Tuition Singapore shall not be held liable for any disbursements made to an erroneous bank account due to tutor’s oversight when entering his/her beneficiary bank details. All disputes are to be raised with the respective bank on your own accord.

Megamind Tuition Singapore shall not be held liable for any late or unpaid fees from the tutees. All disbursements will only be made when payments are received in Megamind Tuition Singapore’s bank account on the final day of each month. Should there be an outstanding amount after the last calendar day of each month, Megamind Tuition Singapore will attempt to seek for settlement directly via phone calls, emails, mobile text messages or any other means deemed helpful. In such an event, tutors will play an active role in soliciting the outstanding payments owed directly from the tutee.

Once the outstanding settlements are fulfilled by the tutee, Megamind Tuition Singapore will disburse the payments to tutors no later than 10 business days thereafter.

Commissions charged to tutor

Megamind Tuition Singapore will be imposing a fifty percent (50%) charge to tutors for services provided for the initial 31 days from the service commencement. The 31 day-count will commence from the first tuition session. As such, all tuition fees earned within the initial 31 days of service will be co-shared between Megamind Tuition Singapore and the tutor, in a 50% split. See scenario below:

Scenario A:

A new job is accepted by tutor on 2^nd of May 2022, where it is agreed that tutor shall provide tution service of 1 hour per lesson per week for math tuition on every Thursday. The agreed hourly rate is SGD $40.00.

First tuition lesson to commence on the 12th of May 2022, with subsequent lessons as follow:

Based on scenario above, the co-sharing agreement period will be from 12th May 2022 (commencement of first lesson) to 11th June 2022 inclusive. As such, any tuition fees earned within this period shall be co-shared between the tutor and Megamind Tuition Singapore at a 50% rate.

All tuition fees after 11^th June 2022 shall be 100% earned by the tutor. The co-sharing agreement shall cease after a 31 day period.

Usage of segments of the mobile application

Megamind Tuition Singapore’s mobile application is the primary platform for users to interact and procure our services. Users are solely responsible for all contents and messages posted on the mobile application. Users are to be mindful of their conduct and to ensure that their actions are in accordance to the agreed terms and conditions set by Megamind Tuition Singapore.

There are segments within the mobile application where users are able to post contents freely, which includes, but not limited to:

Job posting function

Users who are in search of a tutor will list their job requirements and specifics under the job-posting tab within the mobile application. A job post that is specific to your needs, duration, price and location will be created and made publicly available for all users of Megamind Tuition Singapore. Due to the nature of the job posting function, users are free to create job postings, add specific notes and comments to hasten and streamline the search process.

It is the sole responsibility for the creator of the job post to ensure a clear, accurate and legitimate information within the job post. Megamind Tuition Singapore shall not be held accountable for any misrepresentation, misleading and inaccurate job posting. Users, both tutors and tutees alike, are to exercise your own judgement when interacting with each job posting.

Private messaging chat-box function

Upon confirmation of job, tutor and tutee will be able to further interact through the in-application private messaging chat-box within the job posting. All contents posted within the chat-box are the sole responsibilities of the sender. All chat contents shall be in relation to the job posting and will be in accordance to the terms and conditions set by Megamind Tuition Singapore. Megamind Tuition Singapore shall not be held accountable for any misrepresentation, misleading and inaccurate private messages and its contents within the private messaging chat-box.

In the event where users are receiving any unsolicited text contents, getting harassed, dealing with unethical conduct, inappropriate requests, received abusive texts or any possible violation of any terms and conditions set by Megamind Tuition Singapore, you are to report the incident to Megamind Tuition Singapore’s administrator with immediate notice.

Megamind Tuition Singapore will not be held liable for contents posted by its user. We do not control or endorse any of the contents posted by user’s free will, and shall disclaims any form of liability resulting from personal communications between users and/or contents posted by user’s free will. Users are encouraged to exercise self discretion when accepting a job and/or interacting in the private messaging chat-box.

Megamind Tuition Singapore will be able to view contents posted by its users within the private messaging chat-box function whenever deemed necessary. Please refer to the privacy policy for further details.

General code of conduct

All users, both tutors and tutees alike, are to strictly abide by the general code of conduct set by Megamind Tuition Singapore. This include, but not limited to:

- Each job created has a minimum requirement of 4 lessons per month with a minimum of 1 hour per lesson. All users, both tutors and tutees alike, are expected to minimally commit to a period of one month, or 4 lessons, and fulfil all classes as stated on the accepted job posting.

- In a situation where a tutee wish to engage an existing tutor for a services other than what was described in the current job posting, a new job post shall be created for the new services, and the tutor can apply directly to it within the mobile application. Should there be a case where tutees engaged existing tutors of Megamind Tuition Singapore without going through the proper channel and procedure of Megamind Tuition Singapore, both parties will be put on a permanent ban from using all services and functions of Megamind Tuition Singapore. Megamind Tuition Singapore takes a serious view of this fraudulent act. Parties might be subjected to further legal proceedings if deemed necessary.

- Always fulfil the entire duration of class as listed in the accepted job posting

- Payments for tuition fees are to be made in full as per invoiced, with no negotiation allowed.

- Do not be late for your classes, in situation where one party is late, you are expected to co-ordinate among yourselves to reach a best solution for both parties (e.g. an extension of tuition class to cover the missed portion of the class due to one party being late)

- Users who do not turn up for tuition classes after an agreement is in place, without prior rescheduling might results in a temporarily suspension of account. Megamind Tuition Singapore will decide the next best approach once a full investigation is done. A written warning, further suspension of service or termination of services may be possibly issued.

- Users are expected to be respectful to different races and their respective cultures and beliefs

- Regular communication and timely progress updates between users and/or parents if need be

- Users are expected to strictly abide by the terms and conditions set by Megamind Tuition Singapore

- Users are expected to strictly abide to all applicable local governing laws

Should your tutor or tutee matched by Megamind Tuition Singapore failed to comply to any of the code of conduct and/or terms and conditions set by Megamind Tuition Singapore, you are to highlight to Megamind Tuition Singapore’s administrator at the earliest notice. An investigation could be set-up by Megamind Tuition Singapore.

Termination and Dismissal

Megamind Tuition Singapore expects all users, both tutors and tutees alike, to strictly adhere to the terms and conditions set by Megamind Tuition Singapore. All users are to act responsibly, conduct themselves appropriately in accordance to all terms and conditions and be liable to their own actions.

Megamind Tuition Singapore reserves the rights to further investigate any issues or concerns raised by other users within the Megamind Tuition Singapore community.

Should there be a need, Megamind Tuition Singapore will terminate and/or discountinue all services to users who are not in compliance to any of the terms and conditions. No prior notices will be required by Megamind Tuition Singapore when such a need for termination and/or discontinuation of services is required. Users and/or any related parties shall be aware that upon any terminations, suspensions or discontinuity of services served to you, Megamind Tuition Singapore shall not be liable for any form of liabilitiies and/or impending losses that might arise as a result.

In the event where a termination, suspension, discontinuation notices is served, Megamind Tuition Singapore will carry out one or all of the following:

- Permanent/Temporary removal of user account access

- Removal of all contents and information within the user account

- Barred from all services provided by Megamind Tuition Singapore

Rights and Ownership

Megamind Tuition Singapore owns and maintains the full intellectual property rights to all its business functions. This include, but not limited to, the following major platforms and materials:

- Megamind Tuition Singapore’s website

- Megamind Tuition Singapore’s mobile application

- Megamind Tuition Singapore’s social media platforms

- Megamind Tuition Singapore’s logo

All materials, contents, information, graphics (pictorial and video format), logo, chats, messages (private and public) which are made available to users of Megamind Tuition Singapore are solely owned by Megamind Tuition Singapore. Users are admitted to the sites and applications with good intentions, to gross and/or procure services from Megamind Tuition Singapore. Users shall not use the website for any reasons that are against the local law, or in any manner that would harm, impair or disable the natural cause of business which will result in loss or damages to the property, reputation, or the overall wellbeing of the business in any way.

Megamind Tuition Singapore is protected by copyrights and other applicable laws. Users agree to follow all copyrights and proprietary regulations in accordance to the local governing law. Users will not re-publish, attempt to modify, transmit, copy, the materials and contents in any manner listed in all platforms owned by Megamind Tuition Singapore. Unless an exception is granted by Megamind Tuition Singapore, all contents shall be solely owned by Megamind Tuition Singapore.

Megamind Tuition Singapore reserves the rights to amend any of the terms and conditions whenever deemed necessary. Users should keep yourself updated to the terms and conditions during your time with Megamind Tuition Singapore. Should the terms and conditions be updated, the latest version of terms and conditions shall supersedes all earlier versions with immediate effect.

The terms and conditions set by Megamind Tuition Singapore will be binding on all users and will prevail over any other forms of communications, written or verbal between Megamind Tuition Singapore and its users.
